These Terms & Conditions (“Terms”) govern your use of the Skye Lounge website (skye-lounge.com), any bookings made through the site, and any services, consultations, digital audio programs, or wellness experiences offered by Skye Lounge LLC (“we,” “us,” “our,” “Skye Lounge”).
By booking an appointment, purchasing audio programs, or using our services, you agree to these Terms.
If you do not agree, please discontinue use.
1. GENERAL OVERVIEW
Skye Lounge LLC provides wellness-based services including Bio-Tuning® assessments, vibroacoustic therapy sessions, neuroacoustic consultations with Dr. Jeffrey Thompson, custom audio programs, and related wellness experiences.
We do not provide medical services, medical devices, clinical diagnosis, or treatment of any kind.
All services and content are intended strictly for wellness, relaxation, personal development, and educational purposes.
2. NO MEDICAL CLAIMS
Our services—including Bio-Tuning® assessments, vibroacoustic chair sessions, Lambda System HRV scans, custom audio tracks, consultations, and all wellness programs—are not medical services and are not intended to diagnose, treat, cure, or prevent any disease.
No service, audio, vibration, consultation, or HRV-related assessment should be interpreted as medical advice or a substitute for professional medical care.
If you have any medical conditions, are pregnant, have a pacemaker, or have concerns about vibration therapy or neuroacoustic experiences, consult your physician before booking.
3. PAYMENT TERMS
By making a purchase or booking, you authorize Skye Lounge LLC and our third-party payment processors (Square, Stripe, PayPal, etc.) to charge your selected payment method for the full amount, including taxes and applicable fees.
All services require full payment at the time of booking.
All prices are listed in U.S. dollars (USD) unless otherwise indicated.
4. BOOKING REQUIREMENTS & LEAD TIME
All appointments require a minimum 2-week advance booking.
This ensures proper scheduling, preparation of custom materials, and availability of practitioners and equipment.
Last-minute booking requests may be accommodated at our discretion but are not guaranteed.
5. APPOINTMENT CANCELLATION & REFUND POLICY
5.1 Cancellation Timeframes & Fees
To protect our business and practitioners’ time, the following cancellation policy applies to all in-person and virtual appointments, including but not limited to:
- Bio-Tuning® initial assessments ($459)
- Dr. Thompson consultations ($999)
- In-person client check-ups
- Remote/virtual consultations
- Sound chair sessions
- Any other scheduled appointment types
Cancellation fees are calculated as follows:

* Payment processing fees (typically 3–4% of transaction total) are non-refundable, as these fees are charged to us by Square, Stripe, PayPal, and other processors and cannot be recovered.
5.2 How to Cancel
To cancel an appointment, you must:
- Email us at [email protected] with your booking details, OR
- Call us directly during business hours, OR
- Use the cancellation link provided in your booking confirmation
Cancellations are time-stamped based on when we receive your notice, not when you intended to cancel.
5.3 No-Show Policy
If you do not attend your scheduled appointment and did not provide any cancellation notice, you forfeit 100% of the payment.
We understand emergencies happen. If you experience a documented medical emergency, family emergency, or unforeseen crisis, contact us within 48 hours and we will work with you on a case-by-case basis.
5.4 Refund Processing
Approved refunds are processed within 7–10 business days after cancellation is confirmed.
Refunds are issued to the original payment method.
6. RESCHEDULING POLICY
We understand that schedules change.
6.1 First Reschedule (Free)
You may reschedule your appointment one time at no charge, provided you give at least 72 hours’ notice.
6.2 Second Reschedule (Fee Applies)
Any second or subsequent reschedule request will be subject to the cancellation fee structure outlined in Section 5.1, based on the amount of notice given.
6.3 Late Reschedules
Reschedule requests made within 72 hours of your appointment are treated as cancellations and will incur the applicable cancellation fee (25% for 24–72 hours; 50% for under 24 hours).
7. PACKAGE DEALS & BUNDLES
7.1 What’s Included
We offer package deals that may include:
- Starter Package ($999): Includes Level 1 audio program (8 tracks), first Bio-Tuning® assessment scan (in-person), and 30-minute sound session on our vibroacoustic chair with your first custom track
- Level 1, Level 2, or Level 3 audio bundles at discounted rates
- Multi-session appointment bundles
7.2 Package Cancellations
If you cancel an appointment that is part of a package deal:
- The appointment portion is subject to the standard cancellation policy (Section 5.1)
- Any digital audio content already delivered is non-refundable (see Section 8)
- The remaining value of unused services or tracks may be refunded at our discretion, minus applicable fees
7.3 Package Expiration
Package deals and bundles must be redeemed within 12 months of purchase unless otherwise stated.
Expired packages are non-refundable and cannot be extended without prior approval.
8. DIGITAL AUDIO PROGRAMS & CUSTOM TRACKS
8.1 Final Sale Policy
All digital audio programs and custom tracks are final sale and non-refundable, including:
- Individual custom Bio-Tuning® tracks ($99 each)
- Level 1, Level 2, and Level 3 audio bundles
- Any custom audio delivered via email, download, or practitioner portal
- Tracks included in package deals
Once audio content is rendered, exported, and delivered to you, no refunds are provided.
8.2 Revision Policy
We want you to love your custom audio. To ensure quality and client satisfaction:
Each custom track includes ONE (1) complimentary revision, provided:
- The revision request is submitted within 30 days of delivery
- The revision is reasonable and related to the original specifications (e.g., volume adjustments, tone preferences, frequency tweaks)
- The request is submitted in writing via email to [email protected]
8.3 Additional Revisions
Additional revisions beyond the first complimentary revision will incur a $25 fee per revision.
We reserve the right to decline excessive or unreasonable revision requests that fall outside the scope of the original track specifications.
8.4 Abuse Prevention
Repeated, excessive, or frivolous revision requests may be declined at our discretion to protect our production team and maintain service quality for all clients.
9. INTELLECTUAL PROPERTY & USAGE RESTRICTIONS
9.1 License Grant
When you purchase a custom audio program or track, you receive a personal, non-commercial, non-transferable license for your own wellness use only.
You do not acquire ownership of the audio files.
9.2 Prohibited Uses
You may not:
- Resell, redistribute, or share audio files with others
- Upload tracks to streaming platforms (Spotify, Apple Music, YouTube, etc.)
- Use tracks commercially or in a business setting (unless you hold a separate practitioner license)
- Alter, remix, reverse-engineer, or create derivative works
- Copy, reproduce, or duplicate files in any format
9.3 Ownership
All audio content, including custom tracks, remains the exclusive intellectual property of Skye Lounge LLC and Dr. Jeffrey Thompson.
Bio-Tuning® is a registered trademark of Skye Lounge LLC / Dr. Jeffrey Thompson.
10. HEALTH & SAFETY DISCLAIMER
10.1 Assumption of Risk
By participating in any Skye Lounge service, you acknowledge and agree that:
- Use of vibroacoustic therapy, sound chairs, Bio-Tuning® assessments, and neuroacoustic audio is entirely at your own risk
- We are not responsible for injuries, discomfort, or adverse reactions resulting from use
10.2 Contraindications
Do not use our services if you:
- Are pregnant
- Have a pacemaker or implanted medical device
- Have a history of seizures or epilepsy
- Are under the influence of drugs or alcohol
- Have been advised by a physician to avoid vibration therapy
If you have any medical conditions or concerns, consult your physician before booking.
10.3 Our Responsibility
Skye Lounge LLC is not responsible for:
- Injuries from improper use or failure to follow instructions
- Discomfort from extended sessions
- Pre-existing medical conditions aggravated by vibration or sound therapy
- Use while impaired, fatigued, or against medical advice
11. LIMITATION OF LIABILITY (DAMAGES CAP)
To the fullest extent permitted by law:
- Skye Lounge LLC is not liable for indirect, incidental, special, punitive, or consequential damages
- Maximum liability for any claim shall not exceed the amount paid by the customer for the specific service or product involved
This includes but is not limited to claims related to personal injury, service dissatisfaction, or technical issues with audio content.
12. LATE ARRIVALS
If you arrive more than 15 minutes late to your scheduled appointment:
- Your session time may be shortened to accommodate other scheduled clients
- You will still be charged the full appointment fee
- If you arrive more than 30 minutes late, we reserve the right to treat this as a no-show (100% forfeit)
Please plan to arrive 5–10 minutes early to complete any necessary intake forms and prepare for your session.
13. CLIENT CONDUCT & TERMINATION OF SERVICE
We reserve the right to refuse service or terminate a client relationship if:
- A client is abusive, threatening, or disrespectful to staff
- A client violates intellectual property restrictions (Section 9)
- A client files false or fraudulent chargebacks (Section 14)
- A client repeatedly violates cancellation policies
14. CHARGEBACKS & PAYMENT DISPUTES
Filing false, unwarranted, or abusive chargebacks for valid services or purchases may result in:
- Suspension of access to future services
- Termination of any active packages or bundles
- Reporting to payment processors
- Submission of all booking records, signed Terms, and communication history to Square/Stripe/PayPal
We reserve the right to present all evidence to dispute invalid chargebacks.
If you have a legitimate issue with a charge, please contact us directly at [email protected] before initiating a chargeback.
15. FORCE MAJEURE
Skye Lounge LLC is not responsible for delays, cancellations, or failure to perform due to events beyond our reasonable control, including:
- Natural disasters (earthquakes, fires, floods)
- Pandemics or public health emergencies
- Government orders or restrictions
- Power outages or technical failures
- Practitioner illness or unavailability due to emergency
In such cases, we will work with you to reschedule or provide alternative solutions, but no refunds will be issued beyond our standard cancellation policy.
16. PRIVACY & DATA HANDLING
We may collect personal and biometric data (such as HRV values from Bio-Tuning® assessments) solely for:
- Custom audio track creation
- Session personalization
- Wellness tracking and optimization
We do not store medical data, perform diagnostics, or sell/share biometric information with third parties.
Your data is handled in accordance with our Privacy Policy.
17. WEBSITE USE & INTELLECTUAL PROPERTY
All content on the Skye Lounge website—including text, audio, images, videos, design elements, software, branding, and trademarks (including Bio-Tuning®)—is owned by Skye Lounge LLC.
You may not reproduce, copy, publish, or create derivative works without written permission.
18. GOVERNING LAW
These Terms are governed by the laws of the State of California.
All disputes must be resolved exclusively in San Diego County, California.
19. SMS & COMMUNICATION CONSENT
We may send transactional SMS messages (e.g., appointment reminders, booking confirmations).
We will not send marketing text messages without explicit opt-in consent.
You may opt out of SMS communications at any time by replying STOP.
20. MODIFICATIONS TO TERMS
We may update these Terms at any time. The latest version will always appear on this page with an updated “Last Updated” date.
Continued use of the website or booking of services constitutes acceptance of any updated Terms.
